  Specific labor law encompasses staff regulations in the public sphere, understood as the public sector of employment (at the national and local level), which includes entities of the public finance sector enumerated in art. 9 of the Act on Public Finance. The employers acting in this sphere have a different administrative status as well as certain administrative freedom in relation to the authorities that form them. The public sector, thanks to a highly developed bureaucratic apparatus as well as a strictly hierarchical structure in the ranks, constitutes a highly fertile ground for mobbing, which negatively affects not only the people who work there but also their families, clients and the whole society. In the public sector, the rules of creating particular administrative entities which serve as employers, their transformations and liquidations, as well as the filling of managerial positions are much more rigid. People who engage in authoritarian mobbing fare very well in the public sector, where issues such as promotions, pay rises, bonuses and prestigious tasks are entirely subjective and ultimately in their immediate superior’s purview. Nonetheless, according to art. 943 § 2 E. C., such harassment or intimidation must be persistent and particularly disruptive to be classified as mobbing.;
  Le droit de travail singulier englobe les pragmatiques de service (de fonction) qui apparaissent dans la sphère publique. Ici, nous avons affaire à la sphère d’emploi définie comme sphère de budget (étatique et locale), englobant les « unités du secteur des finances publiques », mentionnée dans l’article 9 de la loi sur les finances publiques. Les travailleurs de cette sphère ont un statut administratif particulier et une certaine particularité administrative et juridique à l’égard des autorités qui les forment. Le secteur public ‒ grâce à un appareil bureaucratique développé et à ce qu’il s’appuie sur le principe du caractère hiérarchique des relations de la dépendance de service ‒ constitue un terrain particulièrement prédisposé au harcèlement professionnel qui suscite des conséquences négatives non seulement pour les personnes qui y travaillent, mais aussi pour les membres de leurs familles, les clients et pour toute la société. Dans la soi-disant sphère budgétaire, les principes liés à la différenciation des unités particulières organisationnelles étant les employeurs, à leur transformation et liquidation, mais également la nomination aux postes de commandement sont plus stricts. Les harceleurs autoritaires se sentent parfaitement bien dans le secteur public où l’admission aux promotions, aux augmentations, aux primes et aux tâches prestigieuses a un caractère appréciatif, et la décision définitive dépend du supérieur. Cependant, l’oppression ou l’intimidation doivent se caractériser par la pénibilité plus que légère et durer longtemps pour qu’on puisse les qualifier de harcèlement professionnel dans le sens inclus dans l’article 943 § 2 du Code de travail.;
  Szczególne prawo pracy obejmuje pragmatyki służbowe (pracownicze), występujące w sferze publicznej. Mamy tu do czynienia ze sferą zatrudnienia określaną jako sfera budżetowa (państwowa i samorządowa), obejmującą „jednostki sektora finansów publicznych”, wymienione w art. 9 ustawy o finansach publicznych. Pracodawcy tej sfery mają odrębny status administracyjny i pewną odrębność administracyjnoprawną wobec władz, które je tworzą. Sektor publiczny, dzięki rozbudowanemu aparatowibiurokratycznemu oraz mającemu oparcie w zasadzie hierarchiczności stosun-kowi podległości służbowej, stanowi szczególnie podatny grunt dla mobbingu, który wywołuje negatywne skutki nie tylko dla zatrudnionych tam osób, ale również dla członków ich rodzin, interesantów i dla całego społeczeństwa. W tzw. sferze budżetowej zasady wyodrębniania poszczególnych jednostek organizacyjnych będących pracodawcami, ich przekształceń i likwidacji, a także obsady stanowisk kierowniczych są bardziej sztywne. Mobberzy autorytarni doskonale czują się w sektorze publicznym, gdzie dopuszczenie do awansów, podwyżek, premii, prestiżowych zadań ma charakter uznaniowy, a ostateczna decyzja zależy od zwierzchnika. Nękanie lub zastraszanie musi charakteryzować się jednak więcej niż małą uciążliwością oraz trwać dłuższy czas, aby mogło zostać zakwalifikowane jako mobbing w rozumieniu art. 943 § 2 k.p.
