The article raises a subject of an institution of hearing the minor in Polish legal system – mainly in Polish civil proceeding. All mentioned issues mostly pertain to matters connecting with international regulations in this purview as well as to question concerns to disparities between hearing the child in litigious and non-litigious proceeding. Moreover, considerations depict premises (age, maturity, condition of each child), which determines the possibility of using the under discussion institution. Furthermore the publication presents the practical problems with exploiting the institution of hearing the minor.;
Artykuł porusza temat dotyczący instytucji wysłuchania małoletniego w polskim systemie prawnym ‒ w szczególności polskiego postępowania cywilnego. Poruszane kwestie odnoszą się przede wszystkim do spraw związanych z regulacjami międzynarodowymi w tym zakresie, a także do różnic między cywilnym postępowaniem procesowym i nieprocesowym. Rozważania opisują również przesłanki, których spełnienie warunkuje możliwość skorzystania z omawianej instytucji. Ponadto w artykule zaprezentowane zostały praktyczne problemy wykorzystywania instytucji wysłuchania dzieci.
