Dieser Beitrag beschreibt theoretische Aspekte zur intersystemischen Übersetzung von Gesetzestexten Norwegisch-Deutsch zwecks Informationsgewinnung. Beim Vergleichen von Rechtsordnungen wird zwischen internationaler, supranationaler (EU) und nationalen Rechtsordnungen unterschieden. Da jede Rechtsordnung ein eigenes Begriffssystem hat, ist die große Herausforderung beim Rechtsübersetzen, wie verschiedene Begriffssysteme und deren Benennungen in zwei verschiedenen Rechtssprachen in Einklang gebracht werden können. Häufig wird deshalb behauptet, dass das ideale Profil eines Rechtsübersetzers aus Kompetenzen von sowohl einem Rechtskomparatisten als auch Linguisten bestehen sollte. In diesem Sinne dient eine Fallstudie über jüngst erfolgte Änderungen im norwegischen und deutschen Familienrecht über Mutterschaft/Vaterschaft als Veranschaulichung einer interdisziplinären Herangehensweise beim Übersetzen zentraler Begriffe aus dem Norwegischen ins Deutsche.;
This paper presents theoretical aspects of the intersystemic translation of legislative texts from Norwegian into German for informative purposes. When comparing legal systems, one differentiates between international, national and supranational legal systems. Since each legal system has its own conceptual system, the prevailing challenge in legal translation (studies) is how to reconcile different conceptual systems and their denominations in two different legal languages. Therefore, it is often argued that the ideal profile for a legal translator should consist of a combination of skills of both lawyers and linguists. In this vein, a case study on recent changes in Norwegian and German family law concerning motherhood/fatherhood is used to illustrate an interdisciplinary approach to translating central concepts from Norwegian into German.;
Niniejszy artykuł skupia się na teoretycznych założeniach międzysystemowego przekładu tekstów ustawowych z języka norweskiego na język niemiecki. Przy porównywaniu systemów prawnych, dokonuje się rozróżnienia na międzynarodowe, krajowe i supra-krajowe systemy prawne. Jako, że każdy z systemów prawnych posiada własny system pojęciowy, olbrzymim wyzwaniem w badaniach nad przekładem prawnym jest sposób rozpoznawania różnych systemów pojęciowych oraz ich odwzorowanie w różnych językach prawnych i prawniczych. Stąd często argumentuje się, że tłumacz prawny i prawniczy powinien posiadać kompetencje prawnicze jak i językoznawcze. Do zilustrowania podejścia interdyscyplinarnego w przekładzie pojęć kluczowych z języka norweskiego na język niemiecki posłużyło studium przypadku niedawnych zmian w zakresie ojcostwa i macierzyństwa w prawie norweskim i niemieckim.
