  The article poses a question about the current meaning of the Universal Declaration of Human Rights. The starting point is the analysis of the legitimacy of the Declaration, which leads to the conclusion that the support for it has not been eroded by the passage of time, but has indeed gained strength. The Declaration's message on the universality of human rights is taken from the perspective of the controversy surrounding this principle during the drafting process and in the light of the subsequent debates related to the Second World Conference on Human Rights in Vienna in 1993. The Declaration and Programme of Action not only stressed that the universal nature of human rights is beyond question, but also pointed to the importance of national and regional specificities, and various historical, cultural and religious conditions that, however, do not relieve states, regardless of their political, economic and cultural systems, of the obligation to promote and protect all human rights. The InterAction Council's initiative to develop a Universal Declaration of Human Responsibility is presented as an attempt to reconcile different doctrinal and political positions with regard to the universality of human rights. The conclusion of these considerations is the expectation that the already visible tendency to absorb various philosophical, doctrinal and cultural traditions in order to enrich human rights justifications will prevail over attempts to question the universality of rights in the name of regional or other distinctions. The Universal Declaration was also a testimony to the holistic approach to human rights, encompassing economic, social, cultural, as well as personal and political rights. The subsequent winding road in attitudes to the two main categories of rights at the international arena ultimately led to the return of the spirit and letter of the Declaration and the recognition of equality of all rights in the legal and institutional-procedural dimensions. Various aspects of the Declaration's binding force and related controversies have been presented in the context of its status as a resolution of the UN General Assembly, as an interpretation of the UN Charter, as customary law and jus cogens, and the concept of so-called UN law. The last part attempts to justify why the Declaration should be seen as a living document.;
  Artykuł stawia pytanie o obecne znaczenie Powszechnej Deklaracji Praw Człowieka. Punktem wyjścia jest analiza legitymizacji Deklaracji, która prowadzi do wniosku, że poparcie dla niej nie tylko nie uległo erozji związanej z upływem czasu, a wręcz istotnie zyskało na sile. Przesłanie Deklaracji dotyczące uniwersalności praw człowieka jest ujęte z perspektywy kontrowersji wokół tej zasady podczas redagowania jej tekstu i w świetle późniejszych debat związanych z II Światową Konferencją Praw Człowieka w Wiedniu w 1993 r. Ta ostatnia nie tylko podkreśliła, że uniwersalny charakter praw człowieka jest poza dyskusją, ale również wskazała na znaczenie specyfiki narodowej i regionalnej oraz różnych uwarunkowań historycznych, kulturowych i religijnych, które jednak nie zwalniają państw – niezależnie od ich systemów politycznych, gospodarczych i kulturowych – z obowiązku promowania i ochrony wszystkich praw człowieka. Inicjatywa InterAction Council zmierzająca do opracowania Powszechnej Deklaracji Odpowiedzialności Człowieka jest przedstawiona jako próba pogodzenia różnych stanowisk doktrynalnych i politycznych w odniesieniu do uniwersalności praw człowieka. Konkluzją tych rozważań jest oczekiwanie, że już widoczna tendencja do absorbowania rozmaitych źródeł filozoficznych, doktrynalnych, a także tradycji kulturowych dla wzbogacania uzasadnień praw człowieka będzie przeważać nad próbami kwestionowania uniwersalności praw w imię regionalnych lub innych odrębności. Powszechna Deklaracja była również świadectwem holistycznego podejścia do praw człowieka, obejmującego prawa gospodarcze, socjalne i kulturalne oraz prawa osobiste i polityczne. Późniejsze meandry stosunku do obu głównych kategorii praw na arenie międzynarodowej doprowadziły ostatecznie do powrotu ducha i litery Deklaracji oraz do uznania równości wszystkich praw w wymiarze prawnym i instytucjonalno-proceduralnym. Rozmaite aspekty mocy wiążącej Deklaracji i odnoszące się do nich kontrowersje zostały przedstawione w kontekście jej statusu jako rezolucji Zgromadzenia Ogólnego ONZ, jako interpretacji Karty ONZ, jako prawa zwyczajowego i ius cogens oraz koncepcji tzw. prawa ONZ. W ostatniej części podjęto próbę uzasadnienia, dlaczego Deklaracja powinna być postrzegana jako dokument żywy.
