  This study deals with the issue at the interface between constitutional rights andfreedoms in the Republic of Poland, administrative law and insolvency law. The questionarises whether the Law on Higher Education and Science constitutes the basis for theMinister of Education and Science to refuse to grant permission for the establishment ofnew majors by a university in restructuring, due to the university’s failure to regulate thearrangement obligations in the restructuring, covered by the statutory moratorium on theirrepayment? The above dilemma may be the subject of an interesting legal dispute. On theone hand, the right to education must be taken into account. On the other hand, financialstability is required from a university creating a new field of study. The study presents theview in which the establishment of a new field of study by a university under restructuringis allowed. It is also a contribution to research on the legal position of an “atypical”debtor in restructuring.;
  Niniejsze opracowanie odnosi się do zagadnienia pozostającego na styku prawi wolności konstytucyjnych w Rzeczypospolitej Polskiej, prawa administracyjnego i prawao niewypłacalności. Powstaje pytanie, czy Prawo o szkolnictwie wyższym i nauce stanowi podstawę dla Ministra Edukacji i Nauki do odmowy udzielenia pozwolenia na utworzenienowych studiów przez uczelnię w restrukturyzacji, z uwagi na nieregulowanie przez uczelnięw restrukturyzacji zobowiązań układowych, objętych ustawowym moratorium na ichspłatę? Powyższy dylemat może być przedmiotem interesującej dysputy prawniczej. Z jednejstrony należy brać pod uwagę prawo do nauki. Z drugiej strony od uczelni tworzącejnowy kierunek studiów wymaga się stabilności finansowej. Opracowanie prezentuje pogląd,w którym dopuszcza się utworzenie nowego kierunku studiów przez uczelnię w restrukturyzacji.Jest to zarazem przyczynek do badań nad pozycją prawną „nietypowego” dłużnikaw restrukturyzacji.
