  The aim of the article is to confront the postulate of the comprehensibility of legal texts with the derivative concept of the interpretation of law by Maciej Zieliński. The point of reference are provisions of penal legislation (norms or criminal law and their understanding) and how they are understood by persons with vocational, secondary and post-secondary education, who constitute the majority of the Polish population. Using the protective function of the penal law, an attempt has been made to question the thesis that provisions of criminal law are comprehensible and understood by their interpreters who are the above individuals. The assumptions of the derivative concept of interpretation require that the interpreter has an extraordinary legal knowledge. Therefore the area where the traditional formula of ignorantia legis non excusat is used should be considerably limited.;
  Przedmiotem artykułu jest konfrontacja postulatu komunikatywności tekstu prawnego z derywacyjną koncepcją wykładni prawa Macieja Zielińskiego. Przedmiotem odniesienia uczyniono normę sankcjonowaną z perspektywy osoby o wykształceniu zawodowym, średnim i policealnym, a więc dominującym wśród polskiej populacji. Wykorzystując ochronną funkcję prawa karnego, autor podjął próbę zakwestionowania tezy, że przepisy karnoprawne są komunikatywne dla tak określonego interpretatora. Zastosowanie założeń derywacyjnej koncepcji wykładni uświadamia, że zarówno zjawisko rozczłonkowania (na poziomie syntaktycznym oraz treściowym) oraz wykorzystanie dyrektywy języka prawniczego (literatury i orzecznictwa), które – ponieważ stanowią powszechnie obowiązujący materiał interpretacyjny na równi z wykładnią autentyczną i mają w działaniu interpretacyjnym pierwszeństwo przed językiem ogólnym – wymagają od interpretatora nieprzeciętnej wiedzy prawniczej oraz prowadzenia żmudnych poszukiwań, co czyni prawo karne niezrozumiałym. W konsekwencji istotnemu praktycznemu ograniczeniu powinna podlegać sfera stosowania tradycyjnej formuły ignorantia legis non excusat.
