  The 1997 Polish Constitution does not clearly identify the relevant organisational and legal elements of higher education since the description of Poland’s social and economic system plaid down in this fundamental act is not very precise. In this state of affairs, various concepts can be developed to define the place of higher education in the system of governmental responsibilities and the permissible legal status of universities. The author attempts to define the nature of obligations (benefits) resting upon public authorities under Article 70 para. 1 subpara. 4 of Poland’s Constitution, describing them as public responsibilities pursued through organisational, coordinating, controlling and supervisory functions, and creating the environment for the universal right to education to be exercised. One of the essential obligations resting upon educational organisations is the obligation to cooperate. This obligation pertains to all constituents of the higher education system which perform public functions, regardless of their organisational and legal format or ownership status. Under the Polish Constitution, entities which offer educational services may be treated as entrepreneurs. The author points out that in this case all rules applicable to entrepreneurship (e.g. antitrust bans, fair competition clauses) should apply to activities undertaken by universities-entrepreneurs. The article proposes that educational responsibilities should be pursued in formats such as public-private partnership, public procurement and the stakeholder framework. The author expresses a view that in the future knowledge society, the legal features of universities should protect them against losing their mission-oriented role but should also guarantee their stable position in the system which satisfies individual and social needs and rights to education and teaching.;
  Na gruncie Konstytucji Rzeczypospolitej Polskiej z 1997 roku nie da się jednoznacznie wskazać istotnych elementów organizacyjno-prawnych szkolnictwa wyższego. Wiąże się to z mato precyzyjnym określeniem ustroju społeczno-gospodarczego kreowanego przez polską ustawę zasadniczą. W tym stanie rzeczy uzasadnione są różnego rodzaju koncepcje miejsca szkolnictwa wyższego w systemie zadań państwa oraz dopuszczalnego statusu prawnego szkół wyższych. Autor podejmuje próbę odpowiedzi na pytanie o charakter powinności (świadczeń) władz publicznych, wynikających z art. 70 ust. 1 pkt 4 Konstytucji, uznając je za zadania publiczne realizowane przez działania organizatorskie, koordynacyjne, kontrolne i nadzorcze, tworzące warunki powszechnego prawa do nauki. Za jeden z najważniejszych obowiązków podmiotów edukacyjnych uznawany jest obowiązek współdziałania wszystkich elementów składowych systemu szkolnictwa wyższego wykonujących zadania publiczne; bez względu na ich charakter organizacyjno-prawny i status własnościowy. Na gruncie polskiej konstytucji nie da się wykluczyć traktowania podmiotów świadczących usługi edukacyjne jako przedsiębiorców. Autor zwraca uwagę, iż w tym przypadku do działań uczelni-przedsiębiorców powinny być stosowane wszystkie reguły związane z działaniami przedsiębiorczymi (np. przepisy antymonopolistyczne, nakaz uczciwej konkurencji itp.). W artykule sugerowana jest też możliwość korzystania w realizacji zadań edukacyjnych z form partnerstwa publiczno-prywatnego, zamówień publicznych, a także wykorzystywanie koncepcji interesariuszy. Autor wyraża przekonanie, iż w przyszłym społeczeństwie wiedzy szkoły wyższe powinny legitymować się cechami prawnymi chroniącymi je przed utratą charakteru misyjnego, a zarazem gwarantującymi trwałe miejsce w systemie zaspokajania indywidualnych i społecznych potrzeb oraz praw do nauki i nauczania.
