  The article addresses the issue of the legal significance of the competencies of public administration bodies to request an expert or experts to issue an opinion. In accordance with Article 84 section 1 of the Code of Administrative Procedure (CAP), when special information is required in a case, a public administration body may ask an expert or experts to issue an opinion. The use of the word may in this provision suggests that the authority conducting administrative proceedings may freely decide whether to request an expert opinion. This interpretative approach is unacceptable from the perspective of Article 7 of the CAP. Therefore, during the considerations, special emphasis is placed on determining the meaning of the word may. The analysis is carried out using the dogmatic-legal method. It is established that the authority is empowered to assess whether it is necessary to use special information to resolve the matter. Therefore, the authority is entitled (using the language from Article 84 of the CAP: may) to indicate whether its statutorily defined ‘substantive competences’ include information on specific circumstances or whether they constitute expert knowledge. It is also established that the concept of special information within the meaning of the CAP should not be interpreted in the same way as in the case of other procedural acts. It is assumed that the above-mentioned concept should be understood as knowledge that the legislator does not require from the entity conducting specific administrative proceedings.;
  W artykule podjęto zagadnienie prawnego znaczenia kompetencji organów administracji publicznej w zakresie zwracania się do biegłego lub biegłych o wydanie opinii. Zgodnie z art. 84 ust. 1 Kodeksu postępowania administracyjnego (k.p.a.), gdy w sprawie wymagane są wiadomości specjalne, organ administracji publicznej może zwrócić się do biegłego lub biegłych o wydanie opinii. Użycie słowa może w tym przepisie sugeruje, że organ prowadzący postępowanie administracyjne może swobodnie decydować o tym, czy wystąpi o opinię biegłego. Takie podejście interpretacyjne jest nie do zaakceptowania z perspektywy art. 7 k.p.a. W związku z powyższym w toku rozważań szczególny nacisk położony został na ustalenie znaczenia użytego w przepisie słowa może. Rozważania zostały przeprowadzone z wykorzystaniem metody dogmatycznoprawnej. Ustalono, że organ został wyposażony w kompetencję do dokonywania oceny, czy dla załatwienia sprawy konieczne jest wykorzystanie wiadomości specjalnych. Organ więc jest uprawniony (czyli używając języka z art. 84 k.p.a.: może) do wskazania, czy w jego ustawowo określonych „kompetencjach merytorycznych” mieszczą się informacje na temat określonych okoliczności, czy też stanowią one wiedzę ekspercką. Ustalono również, że pojęcie wiadomości specjalnych w rozumieniu k.p.a. nie powinno być interpretowane w taki sam sposób, jak w przypadku innych aktów proceduralnych. Przyjęto, że przez przywołane pojęcie rozumieć należy wiedzę, której posiadania ustawodawca nie wymaga od podmiotu prowadzącego określone postępowanie administracyjne.
