  Constitutionality of restricting the freedom of assembly in Poland regarding to COVID-19 outbreak

  This article presents issues about the essence of the freedom of assembly, the definition of assembly according to Constitution of the Republic of Poland and Law on Assemblies and possibility of limitating this civil freedom in Constitution. There are also presented issues about state of the epidemic, which was implemented in Poland on 20th March 2020, and the restrictions connected with its implementation. Article also mentions govermantal antiepidemic regulations and their role in shaping law, which point is to stop the transmission of SARS-CoV-2 virus. Those regulations introduced by goverment (in terms of restricting assemblies) have been compiled with current jurisprudence of common and administrative courts.;
  W artykule przedstawiono zagadnienia dotyczące istoty wolności zgromadzeń oraz definicję zgromadzeń, a także możliwość ograniczenia wolności z art. 57 ustawy zasadniczej na poziomie art. 31 ust. 3 i art. 233 Konstytucji RP. Przedstawiono także pojęcia odnoszące się do wprowadzonego w ubiegłym roku na terenie Polski stanu epidemii oraz ograniczeń, które w związku z tym stanem mogą zostać wprowadzone. W artykule pojawia się także wątek rozporządzeń przeciwepidemicznych Rady Ministrów oraz ich wpływu na kształtowanie prawa dotyczącego obostrzeń zapobiegających transmisji wirusa SARS-CoV-2. Rozwiązania prawne dotyczące ograniczenia zgromadzeń wprowadzane przez Radę Ministrów zostały w niniejszym artykule zestawione z bieżącym orzecznictwem sądów powszechnych i administracyjnych.
