  The Author analyses the question of freedom of scientific research in the 1997 Constitution of the Republic of Poland and goes back to previous fundamental acts of law: the so-called March Constitution, April Constitution and the Constitution of the People’s Republic of Poland. He points out that freedom of scientific research and artistic work, freedom of teaching and freedom of using cultural achievements occupy inferior positions in the Constitution compared with freedom of the press and of other mass media. However, the Author stresses that freedom of scientific research is also pushed to the background in constitutions elsewhere, not only in Poland. He also discusses definition problems and analyses the meanings of notions such as, e.g., “creative work”, “scientific creative work”, “artistic creative work”, “creator/author”, “creative work”, “science/research” as well as the boundaries of freedom in scientific research.;
  Autor rozpatruje kwestię wolności badań naukowych w Konstytucji Rzeczypospolitej Polskiej z 1997 r., a także wraca do poprzednich polskich ustaw zasadniczych: konstytucji marcowej (1921), kwietniowej (1935) i Konstytucji PRL (1952). Zwraca uwagę, że wolność badań naukowych, a także twórczość artystyczna, wolność nauczania i wolność korzystania z dóbr kultury zajmują w Konstytucji RP pośledniejsze miejsce niż wolność prasy i innych środków masowego przekazu. Podkreśla jednak, że przesunięcie na drugi plan wolności badań naukowych nie jest specyfiką wyłącznie polską. Zajmuje się również kwestiami definicyjnymi, rozpatrując m.in. znaczenie pojęć „twórczość”, „twórczość naukowa”, „twórczość artystyczna”, „twórca”, „utwór”, „nauka”, a także granicami wolności prowadzenia badań naukowych.
