In the process of deciding upon an appropriate equivalent for a legal term, the translator can choose between several possible strategies. The goal of the article is to analyse the translation strategies of French and Czech legal terms that do not have a direct equivalent in accessible terminographic sources of the target language. Among the possible strategies, it deals in particular with literal translation, functional equivalence and descriptive. It observes that all of the three strategies are used, to a greater or lesser extent, by the analysed terminographic sources and seeks to point out the problems that the use of each of the previously mentioned strategies may cause.;
Dans le processus de décision lors de la recherche de l’équivalent approprié d’un terme juridique dans la langue cible, le traducteur a le choix entre plusieurs stratégies. L’article vise à analyser les stratégies de traduction des termes juridiques français et tchèques qui n’ont pas d’équivalent direct dans la langue cible dans les sources terminographiques disponibles. Parmi les différentes stratégies, il s’occupe notamment de la traduction littérale, de l’équivalence fonctionnelle et de la traduction descriptive. Il constate que les trois stratégies sont utilisées dans une mesure plus ou moins importante par les sources terminographiques analysées et cherche à signaler des problèmes que l’emploi de chacune des stratégies mentionnées peut comporter.  ;
W procesie podejmowania decyzji nad właściwym dla terminu prawnego ekwiwalentem tłumacz dokonuje wyboru spośród wielu dostępnych strategii. Celem niniejszego artykułu jest analiza strategii tłumaczeniowych francuskich i czeskich terminów prawnych, które nie posiadają bezpośredniego ekwiwalentu w dostępnych źródłach terminograficznych danego języka docelowego. Pośród potencjalnych strategii odnosi się szczególnie do tłumaczenia dosłownego, ekwiwalencji funkcjonalnej oraz tłumaczenia opisowego. Autorka dochodzi do wniosku, że, w większym lub mniejszym stopniu, wszystkie te trzy strategie znajdują zastosowanie w analizowanych źródłach terminograficznych, oraz wskazuje problemy, które mogą wyniknąć przy wykorzystaniu każdej ze wspomnianych strategii.
