  The subject of this article is the legal instruments for environmental protection and combatting climate change in the Common Agricultural Policy (CAP) for 2023-2027. The analysis was conducted in the context of the agricultural model adopted in the European Union. The starting point of the considerations was the construction of the new CAP and its budget, as well as the shape that the EU legislator gave to the legal instruments of this policy. The possible impact of the geopolitical situation on the implementation of CAP objectives was also examined. The legal instruments for environmental protection and combatting climate change have been significantly strengthened in the new CAP and the disbursement of the increasingly higher amounts of support depends now, among other things, on the implementation of these instruments by the Member States. The green architecture of the CAP has also been expanded. Its objectives are ambitious and concern many spheres of agricultural activity. However, it will only be possible to assess the effectiveness of these environmental-climate instruments once experience of their implementation has been gained. Moreover, it may turn out that due to the need to ensure food security globally, it will be necessary to modify the CAP priorities, even if at the expense of the environment challenges.;
  L’articolo si concentra su strumenti giuridici volti a tutelare l’ambiente e a contrastare i cambiamenti climatici, previsti dalla politica agricola comune per gli anni 2023–2027. La loro analisi è stata svolta nel contesto del modello di agricoltura adottato dall’Unione europea. Il punto di partenza costituiscono la strutturazione della nuova PAC, il budget previsto, nonché l’impostazione che il legislatore dell’UE ha conferito agli strumenti giuridici presenti nella politica in questione. L’autrice valuta, inoltre, un possibile impatto che l’attuale situazione geopolitica potrebbe avere sul conseguimento degli obiettivi ivi stabiliti. Nella parte conclusiva essa afferma, tra l’atro, che gli strumenti in oggetto sono stati notevolmente rafforzati nella nuova PAC. La loro attuazione da parte degli Stati membri va a condizionare l’erogazione degli importi di sostegno più ingenti. L’architettura verde della PAC è stata ampliata. I suoi obiettivi sono ambiziosi e riguardano molti ambiti dell’attività agricola. Tuttavia per poter valutare l’efficacia degli strumenti climatico-ambientali bisognerà aspettare il momento in cui maturi l’esperienza che deriva dalla loro attuazione. Inoltre, non è da escludere che le priorità di riferimento vengano modificate al fine di garantire la sicurezza alimentare mondiale, anche a scapito delle sfide ambientali.;
  Przedmiotem artykułu są prawne instrumenty ochrony środowiska i przeciwdziałania zmianom klimatu we Wspólnej Polityce Rolnej (WPR) na lata 2023-2027. Ich analiza została przeprowadzona w kontekście przyjętego w Unii Europejskiej modelu rolnictwa. Punktem wyjścia rozważań jest konstrukcja nowej WPR oraz jej budżet, a także kształt, jaki ustawodawca unijny nadał prawnym instrumentom tej polityki. Autorka rozważa ponadto ewentualny wpływ sytuacji geopolitycznej na realizację celów WPR. W konkluzji autorka stwierdza m.in., że w nowej WPR prawne instrumenty ochrony środowiska i przeciwdziałania zmianom klimatu zostały znacząco wzmocnione. Od ich wdrożenia przez państwa członkowskie uzależniona jest również wypłata coraz większych kwot wsparcia. Zielona architektura WPR została rozbudowana. Jej cele są ambitne i dotyczą wielu sfer działalności rolniczej. Ocena skuteczności instrumentów środowiskowo-klimatycznych będzie jednak możliwa dopiero po uzyskaniu doświadczeń z ich wdrażania. Ponadto niewykluczona jest zmiana priorytetów WPR ze względu na potrzebę zapewnienia światowego bezpieczeństwa żywnościowego, nawet ze szkodą dla wyzwań środowiskowych.
